This whiteboard is a 1-page overview of Washington’s My Health My Data Act (MHMDA).
Enacted in 2023, the MHMDA is a very powerful health privacy law – one of the strictest privacy laws in the U.S. The law is extraterritorial and quite broad – it applies to a wide range of data beyond what is traditionally thought of as health data. It also applies to geolocation data and biometric data. It has very strong rights and muscular enforcement, including a private right of action. This is a very notable law.
